Public Charge Final Rule

WASHINGTON – The United States Department of Homeland Security (DHS) has issued a final rule, to be published in the Federal Register, that provides clarity and consistency for non-citizens on how DHS will administer the ground public charge inadmissibility. The rule restores the historical understanding of a “public charge” that had been in place for decades, until the previous Administration began considering supplemental public health benefits like Medicaid and nutritional assistance as part of the public charge inadmissibility determination. .

New Jersey led states in challenging the Trump administration's policy and called it out for what it was - inhumane - and put in place policies like the Immigrant Trust Directive, which was designed to strengthen trust between law enforcement officers in New Jersey and the state's diverse immigrant communities. Immigrant families in New Jersey in need of medical and food assistance should not be afraid to apply for these important benefits for them and their families, nor should they be afraid to turn to law enforcement if they are victims of a crime. This decision reaffirms our values ​​as a nation and helps ensure that the most needy families can count on basic services essential for their health and well-being.. "
