Immigration and Tax

When it comes to paying taxes, undocumented immigrants have the same obligation as citizens and legal residents of the United States. Federal law in the United States requires that all persons with income in the United States and regardless of their immigration status pay taxes.

"Taxpayers are legally responsible for what's on their tax return even if it was prepared by someone else," says the IRS.

For the IRS, tax fraud is committed when the value of personal or business expenses is immediately increased, expenses that were not incurred are presented to obtain deductions, credits are not granted or exceptions are listed that are not available right.

Being charged with tax fraud or tax evasion is considered a federal crime, punishable by more than five years in jail and a fine of up to $ 250.000.

Complying with tax laws can open the doors to legalization for many undocumented immigrants when immigration reform is enacted. One of the requirements that the Citizenship and Immigration Services Agency, USCIS, requires that applicants for adjustment of status residing in the United States is a copy of their income return filed with the Internal Revenue Service, IRS.

Since 1996, the IRS created the Individual Taxpayer Identification Number (ITIN - Individual Taxpayer Identification Number) so that foreigners and people not eligible for a social security number could file their tax returns.

To apply for an ITIN, the person must include the W-7 form with their tax return. The ITIN application can be done together with the tax return when you do it for the first time. To renew an ITIN, people can send the W-7 form at any time of the year. If the request is accepted, the IRS will send you a letter four to six weeks after the request is made. It will also return any documents that you have submitted with your application. If after six weeks they do not receive a response from the IRS, the person can call the IRS at 1-800-829-1040 to find out the status of their ITIN application.
