USCIS Announces End of COVID-Related Flexibilities

U.S. Citizenship and Immigration Services announced today that certain flexibilities first announced in March 2020 to address the COVID-19 pandemic are ending on March 23, 2023. USCIS previously notified the public in its March 24 announcement. January 2023 that, unless new changes related to the pandemic emerge, the extension of said flexibilities announced on January 24 is the last.

You must respond to any USCIS notice or request dated on or after March 23 with the expiration date indicated on the notice or request. This includes:  

  • Requests for Evidence; 
  • Continuations of Requests for Evidence (N-14); 
  • Notices of Intent to Deny; 
  • Notice of Intent to Revoke; 
  • Notices of Intent to Rescind; 
  • Notices of Intent to Terminate Regional Centers, 
  • Notices of Intent to Withdraw Temporary Protected Status; Y 
  • Motions to Reopen an N-400 Pursuant to 8 CFR 335.5, Receipt of Negative Information After Grant. 

In addition, if you want to file a Form I-290B, Notice of Appeal or Motion, or a Form N-336, Request for Hearing on Decision in Naturalization Proceedings (Under INA Section 336), about a decision dated to beginning March 23, 2023, you must comply with the expiration dates indicated in the form instructions.   

USCIS retains its discretion to provide certain flexibilities, on a case-by-case and as-requested basis, for applicants or petitioners affected by emergencies or unforeseen circumstances, such as natural catastrophes (hurricanes, wildfires, severe weather, etc.), national emergencies (e.g. public health) or serious illness (including COVID). As a reminder, the signature reproduction flexibilities first announced on March 20, 2020 became permanent policy on July 25, 2022.
