USCIS announced that the “public charge” rule will apply to all adjustment requests filed as of February 24, 2020.
USCIS updated its adjustment of status web page on September 22, 2020, to reflect that it is resuming implementation of its new public charge rule.
Additional information provided on the USCIS Public Charge Orders page states that the agency is now requiring the inclusion of I-944 with I-485 for those subject to the final public charge rule. Applicants who do not file I-944 with applications received by USCIS after February 24, 2020, and before October 13, 2020, should expect to receive a Request for Evidence, or RFE, to submit the missing evidence. Adjustment requests received after October 13, 2020, that do not include I-944 will be rejected. However, any application for adjustment that was filed without I-944 and approved during this period will not be re-adjudicated.
