DHS Extends Designations from Certain Countries

WASHINGTON- The Department of Homeland Security announced today the automatic extension of Temporary Protected Status (TPS) designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan. TPS recipients from these six countries will maintain their status as long as they continue to meet all individual requirements for TPS eligibility. The automatic extension of TPS-related documentation includes Employment Authorization Documents (EAD) through December 31, 2022.

We encourage eligible individuals whose TPS under the Haiti designation has been extended by court orders and this notice to apply for TPS under the new designation from Haiti to the recently announced TPS. Doing so will ensure that such person's TPS continues, should the courts terminate their court orders. Additionally, eligible individuals who do not submit an application for Haiti's new designation to TPS during the initial enrollment period may be prohibited from submitting a late initial enrollment during any subsequent extension of designation if they do not meet certain conditions.

This extension ensures continued compliance with various court orders issued by federal district courts in court cases. Ramos, Bhattarai and Saget. Current beneficiaries under the TPS designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua, and Sudan do not have to pay a fee or submit an application to maintain their TPS and have their TPS-related documentation issued until December 31, 2022.

Beneficiaries interested in obtaining an EAD showing the expiration date of December 31, 2022, must submit Form I-765, Application for Employment Authorization. An FRN will be released soon that explains how TPS beneficiaries, their employers and benefit-granting agencies can determine which EADs have been automatically extended for those beneficiaries automatically extended for those beneficiaries.
