Support programs for domestic or sexual violence in NJ

The New Jersey Department of Labor and Workforce Development (NJDOL) offers financial support programs for workers who are experiencing domestic or sexual violence and are unable to work. These benefits aim to provide stability while they care for their health or the health of a loved one.

Temporary Disability Benefits

If you are a victim or survivor and are unable to work due to illness, injury, or physical or mental disability, you may be eligible for Temporary Disability Insurance.

  • You can receive up to 26 weeks of benefits, provided it is certified by a medical professional.
  • The application can be made online or with the paper form DS-1 Temporary Disability Application, which you must sign and date if you send it by mail or fax.
  • Remember: You must send both your information and the medical certificate.

Family Leave Benefits

If your loved one is a victim or survivor and you need to care for them or attend to matters related to their situation, you can apply for Family Leave Insurance.

  • It allows up to 12 consecutive weeks or 56 individual days within a 12-month period.
  • You can use these benefits if you need to:
    • Seek medical attention, therapy, or legal services.
    • Plan your safety or take shelter in a refuge.
    • Attend or prepare for court hearings.
    • Recover at home.

Important information regarding workplace protection

Temporary Disability Insurance and Family Leave Insurance are wage replacement programs, but they do not guarantee job security. However, your job may be protected by laws such as:

  • Family and Medical Leave Act (FMLA) at the federal level.
  • New Jersey Family Leave Act (NJFLA) at the state level.
  • The New Jersey SAFE Act protects workers in cases of domestic or sexual violence.
