Reimbursement for Employment Authorization Requests
USCIS mistakenly rejected some applications for employment authorization (Form I-765, Application for Employment Authorization) from U nonimmigrant status petitioners who were filed without a fee (or who applied for a fee waiver) from June 14, 2021 through September 29, 2021. USCIS also accepted fees in error when some status petitioners nonimmigrant U needlessly submitted a fee with your Form I-765. USCIS is currently monitoring this issue and is committed to correcting any errors and expects to issue refunds on or before March 22, 2022.
On June 14, 2021, USCIS implemented a process that allows individuals living in the United States with a determination of authenticity of the Form I-918, Petition for U Nonimmigrant Status pending that they merit the exercise of favorable discretion, receive employment authorization and deferred action. Under this policy there are no fees for an initial Form I-765 filed under 8 CFR 274a.12 (c) (14).
USCIS may provide a refund to individuals if they filed a Form I-765 related to an authenticity determination under eligibility category (c) (14) between June 14, 2021 and September 29, 2021, and paid a fee (either when the form was initially submitted, or when it was resubmitted after it was rejected for lack of fee). USCIS has taken steps to identify affected applicants and establish a process to issue refunds on or before March 22, 2022, where applicable.

Individuals who filed a Form I-765 related to a determination of authenticity under the eligibility category (c) (14) between June 14, 2021 and September 29, 2021, whose Form I-765 was rejected for lack fee and have not resubmitted, they can submit it again without paying a fee.
