Payment and use of earned sick leave

Sick Leave Pay Rate

Payment for earned sick leave should be made at your regular hourly rate.

Under no circumstances may the payment be less than the state minimum wage.

If your salary is not standard, calculate your rate as follows:

Add up your total earnings (excluding overtime) for the last seven days worked and divide that total by the number of hours worked during that period.

This calculation method applies if you:

  • It has a variable salary
  • He holds several positions with the same employer
  • Receives payment per piece (piecework)
  • They receive tips, food, or lodging as part of their compensation

If you are paid on commission, your base hourly wage or the state minimum wage, whichever is higher, must be used.

Unused Sick Leave: Transfer or Payment

You can transfer up to 40 hours of unused earned sick leave to the next benefit year.

Your employer must allow you to use up to 40 hours of benefits per year, even if those hours are from the previous year.

In some cases, your employer may choose to pay you any unused earned sick leave at the end of your benefit year.
