There are state and federal laws that may protect your job while you are on leave. Depending on your situation, your job may be protected by state law, federal law, or both.
State Law: New Jersey Family Leave Act (NJFLA)
The New Jersey Family Leave Act (NJFLA) provides eligible employees of covered employers with up to 12 weeks of job-protected leave within a 24-month period. This leave can be used to care for a loved one or to bond with a new child.
The Family and Medical Leave Act (FMLA) provides eligible employees of covered employers with up to 12 weeks of unpaid, job-protected leave within a 12-month period for specific family and medical reasons. This includes recovery from pregnancy and childbirth.
Your employer cannot retaliate against you for applying for or receiving cash benefits under the TDI/FLI. If your employer retaliates, you have the right to take private legal action.
