State and Federal Labor Protection Laws

There are state and federal laws that may protect your job while you are on leave. Depending on your situation, your job may be protected by state law, federal law, or both.

State Law: New Jersey Family Leave Act (NJFLA)

The New Jersey Family Leave Act (NJFLA) provides eligible employees of covered employers with up to 12 weeks of job-protected leave within a 24-month period. This leave can be used to care for a loved one or to bond with a new child.

For more information, visit the New Jersey Division of Civil Rights page about the NJFLA.

Federal Law: Family and Medical Leave Act (FMLA)

The Family and Medical Leave Act (FMLA) provides eligible employees of covered employers with up to 12 weeks of unpaid, job-protected leave within a 12-month period for specific family and medical reasons. This includes recovery from pregnancy and childbirth.

For more information, visit the United States Department of Labor page.

Protection Against Retaliation

Your employer cannot retaliate against you for applying for or receiving cash benefits under the TDI/FLI. If your employer retaliates, you have the right to take private legal action.

For more information, visit our page about retaliation.
