DHS eliminates automatic extension of work permits

The Department of Homeland Security (DHS) announced a new interim rule ending the practice of automatically extending employment authorization documents (EADs) for certain foreign nationals who submit renewal applications. This measure aims to strengthen background checks and vetting processes to protect public and national security.

From October 30, 2025, individuals applying for renewal of their Employment Authorization Document (EAD) will no longer receive an automatic extension, except in specific cases provided for by law or authorized through an official notice in the Federal Register, such as those related to Temporary Protected Status (TPS).

According to DHS, this new rule will allow for more frequent background checks on applicants, helping to detect potential fraud or threats and ensuring that only those who meet the requirements continue to work legally in the country.

Applicants are advised to submit their renewal well in advance, up to 180 days before their permit's expiration date, to avoid disruptions to their work authorization.
