A benefit year is a 12-month period during which an employee accrues and uses their accrued sick leave. This period can be established in two ways:
Like a calendar year for all employees, or
Individually, according to each employee's hiring date.
How should employers grant accrued sick leave?
Employees accrue one (1) hour of sick leave for every 30 hours worked. Employers may meet this requirement in the following ways:
Early releaseThe employer can grant 40 hours at the start of the benefit year, eliminating the need to track accumulated hours.
Prorated early releaseIf the employee is hired mid-year, the employer may prorate the leave. However, the accrual of one hour for every 30 hours worked must be guaranteed.
