About the Program
New Jersey Temporary Disability Insurance (TDI) provides cash benefits to New Jersey employees who are unable to work due to a physical or mental health condition, or other non-work-related disability. This includes recovery during pregnancy or after childbirth.
Temporary Disability Insurance is a wage replacement program and does not provide job protection on its own. However, during the period an employee receives these benefits, their employment may be protected under federal law. Work Part-Time While Returning to Work
Employees can work part-time while receiving TDI benefits, provided they have their employer's permission. This arrangement allows the employee to work a few hours a day or a few days a week while transitioning back to their full-time schedule.
This option only applies to the last employer the employee worked for before their disability.
How Part-Time Work with TDI Works
- Eligibility: The employee must have received full Temporary Disability benefits for at least 7 consecutive days before being eligible for partial benefits. This period does not include the waiting week. In addition, to receive partial benefits, the employee cannot return to work for more than 14 consecutive days.
- Benefits Calculation: The employee will receive partial benefits. Hours worked will be deducted from the weekly benefits rate, and the employee must provide their work schedule to the New Jersey Department of Labor (NJDOL).
- Duration: Partial benefits can be received for a maximum of 8 weeks. With the approval of the medical provider, this period can be extended to a maximum of 12 weeks.
- Employer's decision: If the employer does not authorize part-time work, the employee may continue to receive full benefits as long as their medical provider certifies that they cannot return to full-time work.
- How to receive partial benefits: After completing the initial application, the employee must fill out Form C05, which is mailed to them. In the "Return to Work Date" field, they must indicate the corresponding date and note that they will be returning to work part-time. The NJDOL will then contact the employee to request additional information.
