Work permits

An Employment Authorization Document (EAD), commonly known as a work permit, allows certain individuals to work legally in the United States. Because processing times can vary, waiting until the permit expires or renewing it shortly before it expires may result in a temporary loss of work authorization.

DACA recipients must pay close attention to their expiration dates. Unlike other work permits, DACA not only grants employment authorization but also protection from deportation while the benefit remains in effect. Allowing DACA to expire can mean losing these important protections and creating unnecessary complications. Therefore, it is crucial to stay informed about expiration dates and submit renewals on time.

Green Card (10-Year Permanent Residence)

Permanent residents receive a Green Card valid for 10 years. Although permanent resident status does not expire when the card expires, an expired Green Card can make it difficult to verify identity and immigration status for employment, international travel, driver's licenses, and other important procedures. For this reason, it is important to renew the card before its expiration date.

Conditional Green Card (2-Year Permanent Residence)

Some people receive a conditional Green Card valid for two years, usually through certain family-based or investment processes. Unlike the 10-year Green Card, conditional residency requires the resident to file a petition to remove the conditions within the period established by USCIS before the card expires. Failure to file this petition on time can jeopardize the person's immigration status and have significant consequences.

When Should You Renew?

USCIS generally recommends submitting renewals or applications within the following timeframes:

• DACA: It is currently recommended to start the process approximately 4 to 5 months before of the expiration date.
• Work permits (EAD): Although some applicants may be eligible to submit the renewal until 180 days before From the expiration date, the recommended renewal period may vary depending on the work permit category. Check the requirements for your category. here.
• 10-Year Green Card: Roughly 6 months before of the expiration date.
• Conditional Green Card: You must submit the request to remove the conditions 90 days before of the card's expiration date.
