Find out who is covered by Earned Sick Leave

Employers of all sizes must provide full-time, part-time, and temporary employees with up to 40 hours of paid sick leave per year so they can take care of themselves or a loved one.

This law applies to almost all workers in New Jersey.

Is it most likely covered?

Most workers are entitled to paid sick leave, regardless of:

  • Whether you work full-time, part-time, seasonal, or temporary
  • How you get paid: salary, hourly, cash, or piece rate
  • The size of the company you work for

Who is not covered by this law?

  • Some types of workers are not included:
  • Construction workers (only when covered by a union)
  • Healthcare workers' travel allowances
  • Public employees who already receive sick leave with full pay under another law
  • Independent contractors

Are migrant workers also covered?

Yes. The New Jersey Department of Labor (NJDOL) does not ask about citizenship and protects all workers, regardless of their immigration status.

The NJDOL does not share personal information with immigration agencies unless required by law. Law enforcement agencies must present a signed warrant and certify that they will maintain the confidentiality of the information.

Furthermore, the NJDOL cannot provide identifying information to a government agency if the complaint was filed against that same agency.
