Family Leave in NJ: What You Should Know

What is Family Leave Insurance?

Family Leave Insurance provides cash benefits to New Jersey workers to bond with a newborn baby, a newly adopted child, or a child placed in foster care, or to care for a family member with a serious illness or injury. Most workers are covered by the state program, although some employers offer this benefit through private insurance. If you are unsure of your coverage, check with your employer.

How and when can I apply for benefits?

You can apply for benefits online, by mail, or by fax. The application includes instructions that should be read carefully before completing it, and it must be signed and dated if mailed or faxed. If you plan ahead, you can start your online application up to 60 days before your leave begins. If you apply after your leave has started, you must do so within 30 days of your first day of absence.

How can I avoid delays in my application?

Applying online is the fastest way. It's important to complete the application fully and accurately, include your Social Security number in all correspondence, and follow all instructions. If you're applying to care for a family member, you must provide instructions to the healthcare provider so they can complete their part; the system doesn't automatically notify them. Don't submit the same application using more than one method, as this can cause delays.

Who qualifies for Family License Insurance?

Most New Jersey workers may qualify if they have contributed to the program through their employment and meet the minimum income requirements. There are some exceptions, such as federal employees, out-of-state workers, religious organizations, and independent contractors.

What happens if my employer didn't make the contributions or I'm unemployed?

If you believe you are covered but your employer did not make the contributions, you are still encouraged to apply, as this could be an error. If you recently became unemployed and need family leave, you may also be eligible and should apply. In that case, your claim will be evaluated under the Family Leave During Unemployment program.
